HR Fact: Statutory Notice Periods – What Employers Must Know

Did you know that under UK Employment Law, all employees are entitled to a minimum statutory notice period when their employment ends — whether they resign or are dismissed?

📋 Statutory minimum notice periods:

  • 1 week if employed between 1 month and 2 years

  • 1 week per full year of service (up to a maximum of 12 weeks) if employed for 2+ years

Employers must also check employee contracts for contractual notice periods, which may be longer but can never be less than the statutory minimum.

✅ Ensuring correct notice periods are followed protects your business from unfair dismissal or wrongful dismissal claims.
